Legal Question in Wills and Trusts in Florida

Personal Representative and Successor trustee

My parents (mother & step-father) had their Last Will & Testament and Revocable Trust Agreements done last month. My sister and I are the only heirs. Also I am named as Personal representative of the Will and Succesor Trustee of the Revocable Trust. What would be my first and most important duties & jobs after their deaths? Do I need an Attorney?

Re: Personal Representative and Successor trustee

As Personal Representative, you would be responsible for initiating probate by filing the will with appropriate forms with the court. Among many things, you are responsible for conducting an inventory of the assets, protecting the assets during probate, and filing taxes. Although not required, it is advisable to retain a probate attorney as probate can be complicated. For further information regarding your duties as both a Personal Representative and Trustee, you can refer to Chapters 731-738 of the Florida Statutes, or if you have further questions feel free to contact me via email or phone at (407) 353-4728.
