Legal Question in Wills and Trusts in Florida

How to Petition the court to not pay attorney

The attorney initially hired by the executrix of my Aunt's estate to represent the estate ended up representing the executrix on a contingency basis as an individual when the funds in the estate ran dry. When approached by him to represent me as well, I said no. Now that the case has settled, he wants to be paid from the estate in totality instead of getting his contingency paid by the executrixes portion alone. The attorney says that If I don't agree with this I need to petition the courts in Broward County FL. How do I go about this and what do you think my chances are for recovery? I have the letter he sent me when he wanted me to hire him and explanations from him as to why he was no longer representing the estate, but the executrix alone. I don't see why I'm now being expected to pay his fees, when 1) I never agreed to it 2) I never had a say in the course of the case.

At the very least, I think he is at fault for misrepresentation and fraud.
