Petition for Discharge

Our mother passed away a year ago and the Guardianship Program notified us that there is money left over in her account. They told us that we need to get a lawyer to file a Summary of Administration. Can this be handled on our own or do we need a lawyer. It is already in the Courts Registry and someone told me that we could just file a Judicial Order. Is this trus. What is this form.

Your question relates to a discharge of a guardianship in Florida. The guardianship attorney is advising you to claim the remaining assets by filing a probate. If the amount is less than $5,000.00 you can do a letter procedure at the clerks office call disposition of property. Over $5,000.00 and less than $75,000.00 requires an attorney to file a Summary Administration. This usual runs between $1500- $2200.00 depending on the situation. www.flprobate.net
