Legal Question in Wills and Trusts in Florida

I have POA and healthcare POA for my 90 year old mother. She has had Alzheimers for the last couple of years and I have had to manage her day to day care and expenses. I now am facing some health challenges myself, If I should not survive or not be able to fulfil my obligations, Can I, as POA, complete new POA documents designating another POA since my mother will not be judged able sign herself???

The original POA needs to be reviewed to determine if you have this authority. Have an attorney discuss the specifics with you. It may require court intervention.

I doubt your POA permits you to appoint another POA. If it does not list a successor, a court guardian may need to be appointed.

My colleagues Mr. Stein and Mr. Slater are correct. Unless your POA has a successor, then you would need to have a guardian appointed. If I can be of assistance, please contact my office for an appointment. 904-997-1031
