Legal Question in Wills and Trusts in Florida

Power of Attorney

I am the POA on investments that my wife and I hold, but I have them in her name with me as Power of Attorney. Is there any time period on a POA other then when it is rescinded by the principal or the death of the principal? Thank you.

Re: Power of Attorney

That depends if the Power of Attorney is titled "Durable" Power of Attorney. If someone has been adjudicated mentally incompetent neither type of Power of Attorney will help. However, if someone has a "Durable" Power of Attorney then this will help in the situation of someone who is not 100% mentally stable but has not been adjudicated incompetent. The rest of your information is correct.
