Legal Question in Wills and Trusts in Florida

Probate was established with the court in 2008 with my sister as rep. To date she has not done what is required to settle prbate and refuses to talk to me about it. The attorney that is suppose to be the estate attorney will not return my calls. I have written to the court requesting she be removed as rep and I made the rep so I can settle the estate since I am the only ther beneficiary. What else can I do in this matter? I can not afford to hire an attorney for I am on a fixed income.

You need to apply for a probono attorney to handle this for you. When it comes to probate, you must have an attorney and before all the assets in the estate are gone, I suggest yo apply soon.

Either Jacksonville Area Legal Aid or Three Rivers.

If the estate has assets, then the estate can pay for the attorney fees. However, that will reduce what you would have received.

Depending upon what you find out in the administration, it may give your attorney the ability to recover something, including from the present attorney if they are not handling it correctly.
