Can a probate lawyer charge a flat fee when was supposed to get paid from the estate and no contract or agreement was made.

Generally, if no fee was discussed, he would be entitled to a reasonable hourly fee (quantum merit).

Yes a flat rate can be charged per statutory percentage which are per se determined to be reasonable. Is that what is occurring? Or did the attorney just come up with an arbitrary flat fee? were there discussions about it or not? The fee needs to be approved by the judge.
