My uncle died, No wife, children or living parents. My dad and his brother are only living siblings. Life insurance changed company in Jan 08 and they did not carry over his designation of benificiary. Life Co. tells us the policy has defaulted to estate and will have to be probated. It is only $2500. Now we find out from FRS (state retirement) that his pension which my father is benificiary on reverts to estate. Do we have to file a probate? He thought before his death that everything had been handled so that nothing would have to be probated.

There is an easy form of probate when the assets are minimal called family administration. You can probably find the forms at the local court house.
