Probateing after a ruling

Can someone sue an insurance company of a deceased, for bodily harm that the policy holder cause to them before the policy holders death? And if the insurance company has alredy paid the benificary how can they sue?

You do not sue an insurance company. You sue the estate of the decedent. Their insurance company

should come in to defend and pay.

You can maintain a tort claim against an estate. AS for insurance, I don't know whether you are refering to liability insurance or life insurance. In any case, the defendant is the estate not the insurance company.
