Legal Question in Wills and Trusts in Florida

probating will

If my father died in Fla, had a residence there and one in NY. But after he died he gave the house in NY to me and my brother, shouldn't his will be probated in FL. He did live longer in NY.

Please get back to me asap.

It should be probated where he was residing at the time of death. How could he give you the house if he was dead?
