Legal Question in Wills and Trusts in Florida

Removal of Guardian

I am filing a Petition to Remove Guardian. I am the only daughter of my Mother (with 2 siblings who attempted to obtain Guardianship, but the Judge threw them ''out of court'' for explainable reasons) and this Guardianship company has had complete power of my Mother and her assets for two (2) years now. I know the Guardianship will fight to the end because my Mother has a little bit of money. (If she did not, they would not object) Well I have my Mother's best interest, always have, always will, and my question is:

How can I go about finding cases that are similar to mine and be able to site them? Maybe this will help my own case. I have never attempted guardianship, but with the negligent actions of the current guardian, I am compelled to fight and fight to the end. My Mother was deemed incompetent and she is not. Her whole identity has been stripped and since she has suffered a stroke, UTI, kidney stones, and has fallen in the NH that ''they'' have her in and broke her hip. Mom has become desperate, despondent and wants to come home. I want her home. Enough is enough.

Please help me.

A loving Daughter

Re: Removal of Guardian

This is an adversarial proceeding. I strongly suggest that you consult an attorney on this. You can find one through your local bar association, usually with a very low initial consultation fee. If you qualify, you can also try your local legal aid. The present guardian will be represented by counsel and you should be too. Best wishes.
