Legal Question in Wills and Trusts in Florida

My sister moved from Oregon to Saint Augustine Florida in 1993 and died of cancer 4 1/2 years ago. She was an (incapacitated or protected) person from a medical mistake in 1983. She suffered from seizures, extreme depression and from the medication. My dad was her guardian in Montana and had an attorney to provide an accounting of guardianship assets to the circuit court of Oregon. My brother was her guardian when she moved to Florida. My dad has asked for the will and he won't tell him how to find it and wont answer any questions. The Oregon conservator values the estate at 200,000. I have no information if my brother was her legal guardian or if the assets of the estate were reported to the court. The only information I have from Florida is a copy of a check with the address of her house. Before my sister died she told me I was in the will, she didn't say if the will was filed with a lawyer or how to find the will. I need help to find my sisters will, and if theres a statute of limitations that my brother has legal right to my sisters estate.

You should consult with an attorney. If she left assets in Florida (e.g. a house titled in her name alone), it will need to be probated here.

You can contact the County Clerk to see if any proceedings were filed in your sisters name.
