Legal Question in Wills and Trusts in Florida
My sister and I recently lost both our father and our aunt (his sister). Neither had a completed will although my aunt had an attorney through her church who was in the process of revising her living trust (she was much older than my father and thought she would pass away first and then her estate would be left to him, but when he passed away first she began the process to revise her living trust but passed away a month and half later. My sister and I are the only living heirs and my sister agreed to retain the same attorney to see the process through probate and take care of the estate. I believe she retained him as executor but the problem is he will not keep in contact with us at all. My sister has repeatedly tried to contact him and to complicate matters, the house my father and aunt lived in was a reverse mortgage with the mortgage company wanting to take control of the house. We were told we could not do anything with the contents of the home which includes all the furnishings and most importantly, my father's ashes. We both live in other states, I live in Tn and my sister lives in Nv and we have had to take care of everything long distance but without advise and guidance from the attorney we don't know what to do. We have not even been told if the estate is in probate yet. We are distrustful of this attorney. What options do we have and what would you suggest our next step to be to get these matters taken care of properly? We have paid money out for filing fees and burial fees and have agreed to pay his attorney fees earlier on. The estate was approximately $30k and they lived in Tampa, Florida. Thanks.
