Is there a state law in florida pertaining to the amount (percentage or otherwise) an executor receives as payment or is it at the discretion of the attorney?

Fees for ordinary services are found in 733.6171. However, there are also fees for extraordinary services as well. These are what are recommended but fees could be higher or lower than the statute. An attorney can't just charge whatever he wants, but it must be reasonable. In general, large estates are done on a percentage and small estates are done on an hourly basis, per what is agreed upon with the attorney.
