Successor Trustee

I was named a beneficiary in a lady�s will who is now deceased. Merrill Lynch is the Trustee of this will. Merrill Lynch wants me to sign a paper saying that they are relinquishing as Trustee and assigning the lady�s nephew who has full power of attorney as Successor Trustee.

I do not like the nephew because he said he would try to cut me out of the will since I was not family.

What are my options here?? Do I need to sign and what happens if I don�t sign ??

Whether you approve or not they can resign. The successor trustee must administer the trust as it is written. If he fails to do so you can obtain court intervention to compel or remove.
