Legal Question in Wills and Trusts in Florida

Terms of my will

I am a British Citizen, resident in

Florida and married to an American

lady, (2nd wife). I have a step-son

from this marriage and 2 daughters

in UK, from my first marraige.

My wife and I have a verbal

agreement that upon my death, she

will be the recipient of the estate,

(except some minor family

heirlooms). The agreement is that

upon her death, the estate wouldbe

equally divided between the 3

children.

When I write a (new) will, is there a

clause which could be included,

which ensures that my wife remains

true to this agreement, i.e. My 2

daughters recieve their share of the

remaining estate?

Verbal agreements don't work in the probate arena. You need to both get wills done properly. See a lawyer.
