Legal Question in Wills and Trusts in Florida
My name is Tim Murphy. My mother passed away 3.5 years ago. I have 5 siblings. Wachovia was named executor/trustee of her estate. The will stated that we each were to receive 1/6th of the estate free of trust except for the youngest, Michael, who's portion was placed in an irrevocable trust. The will stated that the other 5 siblings are beneficiaries of that trust. He had no power to withdraw principal but was to receive interest payments at least quarterly. Somehow he managed to have the trustee changed to my eldest sister who agreed to be the trustee. Michael apparently found a wachovia employee who was allowing him to withdraw principal w/out my sister's knowledge. She was furious about this and it is a clear violation of the term of the trust. She has asked me to find an atttorney willing to file suit against Wachovia for violating the trust conditions. Can you advise of an attorney who would take on this case who has no conflict with Wachovia?
