Transfer of Property Ownership

My brother is a single man who resides in Florida. He is the owner of a condominium which he wants to leave, equally, to me and my sister. Should his will just address this objective. What if he outlives me (I am 6 years younger than him) or my sister (she is 5 years older than him)? Who inherits my share or my sister's share? Is ist determined by our individual wills? Does he need to specify what happens should he outlive one of us?

You brother should talk with an attorney. With a will he should be able to accomplish what ever he wants to. If his will leaves the condo to you and your sister and is silent on what happens if one of you should die first, then your heirs will get your half of the condo. However, the will can be written so that if you or your sister die before your brother, the surviving sibling takes it all. The difficult part is deciding what you want to happen. I suggest your brother speak with a Florida attorney.
