Legal Question in Wills and Trusts in Florida

What happens to my trust account

I am having a difference of opinion with my personal injury lawyer and wish to dismiss him from my case. I also received a settlement from the insurance companies involved, in which my attorney set up a trust account through his office. I understand the interest on this account is giving to the Florida bar through the bank holding this account. Do I have the right to ask my attorney to turn this trust account back over to me?

Thank You

Re: What happens to my trust account

This is a professional responsibilities question rather than a wills & trusts one.

If you do not contest your lawyer's fees, he or she is entitled to withdraw his or her earned fees/contingency fees plus costs from the trust account and should disburse the rest to you. If you are contesting the lawyer's fees, the settlement money must remain in the trust account until an agreement is reached through the courts or otherwise.
