Legal Question in Wills and Trusts in Florida
my trust
My father has been ill since an accident when i was 4 years old and was awarded a large settlement which his mother and brother have control of and have said there is a trust for me for education only. I am 19 and have graduted from high school and not interested in continuing on to colleage and now Dad is getting considerably worse. My question is if dad should pass on am i entitled to any of his estate.?

Chances are the estate and the trust are separate. Hopefully your father has a will, and his will dictates the distribution of his remaining assets. As for the assets in the trust, it truly depends on the language of the trust. I would suggest to you that you get a copy of the trust documents and his will. You may need to consult an attorney to help you review the documents and properly advise you of your rights.

It depends on the terms of the trust and the terms of his will, if he has one. If he has no will, then the assets go first th the wife (50K i think) and 1/3 of the remaining assets. The rest goes to the children.
