Legal Question in Wills and Trusts in Florida

Trust fund. Want to check in on trust that wa set up for my daughter. I did not challenge for conservator because her mom is coustodial parent. The trust is of great amount. I believe her mom is withdrawling from her trust and spending it.. can I see withdrawls made some how.. her mom does not have employment. And is spending excessive amounts of money.. want to protect my daughter.. part of the money includes money we set aside from the loss of our son to ensure our daughter had funds. To cover her needs as she grows. I believe it is being used for day to day stuff and spending of her mother.

Unless you are a beneficiary of the trust you likely have no right to any of the information related to expenditures or withdrawals from the trust. Your daughter likely does have that right but you mention that the mother is the convervator and you likely may not have any standing to make the request for your daughter. You may need to hire an attorney or your daughter who can make proper inquiries on her behalf. You need to consult with an attorney.

I would make the effort to get an accounting.

Have your attorney(as the father of a minor) request an accounting of trust assets/expenses.

If the request is denied-discuss with your attorney if it would be worthwhile to seek an accounting through

the court.
