Legal Question in Wills and Trusts in Florida

co trustee

my brother in-law is co trustee with

my mother in -law but if something

happens to her in anyway then he

becomes sole trustee. the trust

says that she transfered to the

trustee the property listed in the

attached schedule to be

designated as beneficiary of any life

ins. policies described herein.

does that mean she transferred

the property to her co-trustee?

does that mean he now owns it?

and does durable power of

attorney mean that the person that

has it now has complete control of

the other person and all assets?

Re: co trustee

Sounds like it is transfered ti him, AS TRUSTEE, not for his own use, but as part of the trust. The actual language would need to be examined, but it sounds like it goes into the trust to be used in accordance with the trust terms.
