Legal Question in Wills and Trusts in Florida

My uncle died recently June 25 2009 in Cornelia,Ga.,and left a will. In the will he left everything to his living brothers and sisters which he wrote in 1989. He left out of the will my mother (his sister) who died in 1936. Since he wrote the will in 1989 all of his brothers and sisters have died . Can I protest the will.

you can protest anything you want, but that doesn't mean you have a chance at winning. Assuming the will was properly executed, a court is not likely to set it aside. Consequently, the wording of the will, and who takes the property in the event that the named beneficiaries have predeceased is important. I am not licensed in GA, nor do I know anything about GA law, so you really need to retain a GA attorney who handles probate, have him review the exact wording of the will, and have him/her interpret it according to GA law.
