Legal Question in Wills and Trusts in Florida
My wifes father passed away in December 2009. Her younger brother and older sister are executers of the estate. As of May 11,2010 we have not heard from either one of them and she is a beneficiary of the estate. How should we proceed?

If a probate estate is open, the beneficiary is entitled to notice of all proceedings, unless they formally waive the right to receive notice. You can send them a written demand to provide you with information. If no case is yet open, neither "executor" has any legal power to act, as the personal representative must be appointed by the court.
