no will and if court appointed some one to take care of his money

my brother in law passed away in a assisted liveing home he had no will money was takein out of his pension and s/s check each month to pay for his stay the rest was put into a bank account.

My wife and I help pay for his funeral and i would like to get my money back before they give it to his 5 chilren who refused to do anything as far as there father who they hated

You would need to file a claim against the estate, which would state your claim with receipts of payments made and your request for reimbursement.
