Legal Question in Wills and Trusts in Florida

Old Will

My husband of 10 years was divorced in 1992 but did not change his will. He owns a 10 acre property with home that at one time was willed to his ex-wife and children but they got divorced and he sold part of the property to buy out her interest. the property is in his name only. He does not want to put my name on the property but is willing to do a new will. Will this new will replace the one that she had before? Will everything become mine upon his death? She is remarried and lives in Neveda.

Re: Old Will

Yes -- the new will will replace the old will and the assets of the estate, including the property, will pass as designated in the new will (after paying the claims of the estate).

Re: Old Will

I would suggest that you have your husband prepare a new comprehensive estate plan to assure you and his prior family receive what he wants them to upon his death. You may find it desirable to prepare your will indication of assets that come into your possession during you lifetime.if you would need my assistance e-mail me your phone number.
