Legal Question in Wills and Trusts in Florida

will as it relates to unmentioned children

If a will mentions most but not all children and in fact one child is left off completly, does that cause any problem. Is that OK to do or should the will mention the child and say that the child gets nothing ? Does it make a difference ? Would no mention at all enable that child to contest in any way the will or cause problems for the executor of the estate ?

Re: will as it relates to unmentioned children

I recommend that you mention the omitted child, using language such as : "I have specifically failed to make any provision herein for my child, ________________." Do not leave the child a dollar or any such provision, as that makes the chld a beneficiary under the will, entitled to notices, etc.
