Legal Question in Wills and Trusts in Florida

Wills and Estate

Step-daughter gets entire estate according to the Will. Father left nothing in Will for my brother, my brother's two sons or I, who are his only blood relatives. Father left a large estate to the best of my knowledge and I feel that it should be shared equally. The executor of the estate, his step-daughter, put on Death Certificate that she is his daughter. At the time my father married her mother, his step-daughter (the executor) was already a legal adult and 18 years of age and residing in her own home. Father was retired from 20+ years active duty military. What percentage do you feel that I would have to fight this and win? Please feel free to ask any questions you want.

Re: Wills and Estate

Not to be insensitive, but your feeling about what you think is fair is not really relevant. Your father was free to leave his estate to anyone he wanted, blood relative or not. You can basically only successfully fight this if your father either had competency issues when the Will was created or he was unduly influenced in the creation of the Will. If you think either of those issues may apply, then you should contact about probate attorney about contesting the Will.
