Let me make just a few general comments. In Florida, if you have no will, your suviving spouse will take half the probate estate. If you are trying to make sure your children inherit the house, should you pre-decease your new husband, I would recommend some sort of prenuptual agreement be signed between you and yours so that everyone knows your wishes. If you cannot afford legal help, perhaps your children who stand to benefit would be willing to chip in to buy it. The Florida Bar legal referral service also has elderly and low income panels to help at reduced fees. I think you will have a difficult time getting exactly what you want without a little estate planning help. Best Wishes on the wedding!
