Legal Question in Workers Comp in Florida

I was in a car accident 9/15/99 I've had 4 surgeries on my right shoulder. I continue to have pain. Recently I had an MRI and it did not show any issues but I still have pain. My doctor wanted another mri to rule out a re-tear and also PT. The carrier said in so many words it wouldn't help or be neccessary. What are my options?

There is a very important statute of limitations that your claim is bound by. It means that you can never go more than one year without authorized care. Many times carriers will try and lull injured workers into not receiving timely care, or they will try and outright deny care that they are required to provide. In this case, if your doctor has recommended and MRI and PT, IF A CLAIM IS FILED the carrier is obligated to provide it. But they can stall. It is up to you to get assertive. You can either hire an attorney to file a legal claim for the MRI or PT or you can file a petition for benefits yourself by going to the DOAH JCC website. One or the other, this is what you must do.

You really should consult a car accident attorney in your area to discuss your legal rights at this point. An attorney that also handles workers compensation claims would be useful to discuss your rights under both areas of the law
