Legal Question in Workers Comp in Florida

Denying a specialist

I have been to a Workers Comp. Doctor and his instructions are for me to go see a neurology Doctor and requested I have a nerve conduction test done. Workers Comp. denied the Doctor and the testing.

Any suggestions?

If an authorized, treating doctor recommends another doctor and/or testing, it should be authorized. In most cases, the Judge will require the authorization of such doctors/testing as long as it related to the workers' compensation injury, or to the diagnosis of a potential workers' compensation injury.

My suggestion is that you contact the insurance adjuster one last time, and if you do not get a response or authorization within 3 days, retain a qualified workers' compensation attorney immediately.

If your authorized treating work. comp. dr. is recommending the test then you have the right to receive the test. If the carrier is denying the treatment, you should consult an atty. to fight for this benefit.
