Can I settle out of court and still draw disability?

Well, that depends upon the type of disability to which you are referring, and the terms of that disability insurance policy. Remember, the disability insurance policy is a contract of insurance, with certain terms and conditions. However, if you are referring to disability benefits under workers' compensation, the question is no, you cannot continue to collect workers' compensation "disability" benefits after you settle your case.

Again, if you are referring to a disability policy of insurance, or some plan like State Disability Retirement plan, you should discuss the same with either the company that wrote the policy or the person(s) who administer the policy. Furthermore, there are attorneys that can advise you on disability insurance matters. That is beyond the scope of my practice.
