Legal Question in Workers Comp in Florida

I have an employee that fell on the job and sprained his shoulder. I reported to WC and he has been going to therapy, etc. for over two months. He is on light duty and I have accommodated him thus far. Am I required to pay him his hourly wage while he is at the therapist?

It is always best to check with your WC carrier. In general, if your company does not pay for absence from work for non-work related medical treatment then you are not required to pay for absence while an employee is receiving medical treatment for a work related injury. It is permissible for the employee to use sick/vacation leave (if any) for lost time or to seek payment of WC temporary indemnity benefits for any week that their post weekly earnings falls below 80% of their pre-injury average weekly wages, if the reduction is a result of the work injury.
