Normally, the workers comp insurance company tells the employer to offer you light duty work within the doctor's restrictions but if no light duty is available or the employer simply doesn't want you back, the answer is YES...your employer can fire you. Even if you get light duty, there's a good chance you will get fired later on, weeks or months after, since most employers don't really want injured workers back on the job but, by having you work a few weeks or months, you are helping them prove that you are NOT disabled so when you get fired, your case is worth less money. If you think you'll have trouble finding another job within your restrictions if you are fired, I would not hesitate to get a good claimant's workers' comp lawyer NOW!
