Legal Question in Workers Comp in Florida
my father was recently injured on the job by a coworker driving the company's van. my dad went to the company's clinic to get an xray of his knee to see if any injuries had occurred. they stated that nothing was broken and there was swelling there; therefore, pain medicine and inflammation medicine was prescribed for him. a week later, he is still complaining of knee and leg pain from the injury. this morning i called his primary physican to see if he needed to get a second opinion from them and his primary physician stated that he needed to go back to the company's clinic and get furture testing done. my question is, if my father decides to take legal action towards his workplace, is this the proper way to go with handling the injury?also, should he be out on worker's comp. during this process because right now the company have him doing light duty on the job. thank you in advance for your time.

First, you father is entitled to medical care from his empolyer via workers compensation. He can go back to the comp doctor. Going to his own doctor is not considered an authorized doctor and the doc will not get paid.
