Legal Question in Workers Comp in Florida

I hurt myself lifting a server at work. I had a witness that seen me lift the server and then immedialty lay they server back down when I felt something pop in my back. I went to a Quick Med doctor before reporting to work about the injury. The doctor did x-rays and told me that L4, S1 were buldging and the Sacrium cartilage was torn. I then went back to work and reported the injury and had the witness also report. I got sent back to the same doctors office i went to originally and then the doctor on duty that day said my x-rays look just fine and I could return to work after I finish the Vicodin the first doctor prescribed. I am in severe pain and pretty much forced to return to work on light duty. what are my options and what should i do next.

You need to request additional medical attention though your company's workers' compensation carrier. If your employer refuses to set up the treatment you should contact an attorney who specializes in Workers' Compensation and set an appointment to discuss your case.

Also, X-rays do not show whether a disc is bulging and in most all cases will not show torn cartilage either. Bulging discs are soft tissue injuries and do not show on a conventional X-ray. There may be evidence of vertebra misalignment which could indicate a tear or bulge, but more tests have to be done to be sure.

You clearly have a workers' compensation claim. Clinics that provide evaluations for the employer/carrier often are more concerned with returning you to a full duty status than providing meaningful treatment. The theory is "if he is really hurt, then he will come back". I suggest that you do not get involved in these type of medical games with the employer/carrier. I suggest that you contact a workers' compensation attorney in your geographical area who can advise you regarding your medical rights and provide opinions regarding physicians.

I am located in the Palm Beach, Broward and Miami-Dade areas.
