Legal Question in Workers Comp in Florida

Impairment rating

I really appreciate the answer to my question which was, ''Can Work Comp or my employer keep my impairment rating money due to they paid me past the 104 weeks because I had to go through a third back surgery?''. I got a response saying, ''no''. But when I told my lawyer that, he said he didn't know of any case law or statue that supports that answer. This concerns me. Is there any case law or statue that pertains to this?

There is certainly case law regarding overpayment of benefits. If your current attorney can't give you an answer on this question, you should contact a qualified workers compensation attorney to provide you a legal opinion. This is a very specific question, and requires more information than can be provided in this forum.
