Legal Question in Workers Comp in Florida
I was injured at my workplace using a defective food processor... the safety mechanism in the machine failed, but the business owner was making the employees use it anyway by telling us she coulnt pay for a new one, and its not an expensive peice of equipment. I was told by her that we dont use a payroll service or have our own and that the employees are not covered under workmans compensation as she doesnt have any. I have beento the emergency room twice for this as it took off the a god peice of my finger, she is haing people who are unassociatd with the incident sign a type waiver saying i was using said equipemnt improperly, and even promoted a person upon signing. I am horrified that i may be denied treatment due to this situation and that there is no insurance to cover it, The story goes on and on and there are more gruesome details about this place... What are my legal standings?

Most lawyers will provide you a free initial conference and will accept such a case hoping to get their fee from the employer. Your options are to file a workers compensation case; if she has no w/c insurance, to sue her company in tort; sue the manufacturer of the product. All of this needs to be investigated.
