Legal Question in Workers Comp in Florida

can the insurance company cut wages when put on light duty but cant return to work due to no light duty work and next question is there any type of settlement available without closing out file say for unsafe work conditions or pain and suffering and not being able to return to the type of job when injured

Question 1: Yes, they can cut your wages but the WC carrier must pay termporary partial disability which is about 60% of the difference.

Question 2. Generally, the answer is no, most carriers will not settle a claim without also closing future medical expenses.

More importantly, you are in dangerous waters and risk losing your job and hurting whatever case you have by not hiring the best claimant lawyer you can find. Most likely, you'll have to go to Jacksonville or Orlando to find an aggressive WC claimant lawyer. I retired recently, and I could refer you to several aggressive lawyers in Miami who handle cases statewide, but if you'd prefer someone closer to you, you'll have to resort to the yellow pages or a friend. I've handled these cases for 34 years before I retired, and trusting your employer and their insurance carrier to do the "right thing" is like trusting the fox to watch the henhouse!!.
