Legal Question in Workers Comp in Florida
Is this a legal claim?
I was carry a large box down some stairs and I missed the last step. The box slipped a I caught it with my left hand. I had pain in my hand and wrist, but I didn't report it to my safety advisor. I did tell my secretary about it and told her I would take it easy for a few days to see if it felt better. Well the next day I was terminated with no reason given and now two weeks later I am still having pain and it doesn't seem to be getting any better. Do I have any recourse against my employer?

You have 30 days from the date of injury to file a timely notice of injury with your employer or their compensation carrier. Do so immediately and ask for medical care to be authorized. If you find that the employer or the carrier or both won't accept your report, or won't authorize a medical evaluation, contact a workers' compensation board certified lawyer for help.

This should be pursued as a workers' compensation claim and your employer should be given actaul notice by you within 30 days of the accident. You would be entitled to the Workers' Compensation medical benefits regardless of your employment status with the employer. Your entitlement to lost wages will depend on your work status from the doctor and the basis of your termination. If the employer refuses to file the notice of injury for you, you can contact the Employee Assistance Office, or retain a Workers Compensation Attorney.
