Legal Question in Workers Comp in Florida
I live in Texas but my employer is in Florida
I was injured on 12-16-03. I fell out of a truck I was loading on a lowboy trailer. I didn't notify my employer immediately. I have been denied workman's comp in Texas and Florida, for untimely notification. I have a back injury and just want medical treatment paid. I had a lawyer in Texas but they said they can't take the case after all because it has to be handled out of Florida. I do have an eye witness of my accident who also works for the same company and is willing to give a statement. I can't travel because of the pain, can I get a lawyer in Florida without being there?

With all due respect and contrary to what the previous attorney replied, you may be required to pursue workers' compensation benefits if there was no negligence on the part of the employer. I would need some additional facts. First, how long you waited to report the injury. Under Florida law, an injured worker has 30 days from the date he knew, or should have known of an injury resulting from a work-related accident. Next, I need to verify that the accident occurred in Florida, and what part of Florida. I do handle cases all over the state of florida, and would be happy to review your case.
