Legal Question in Workers Comp in Florida

how long does a workers comp. case last?

i got injured at work on oct. 5th 2007, ihave multiple back issues and went to a doctor through workmans comp. and the doctor rated me mmi with two limitations. i've had no treatment at all. i went to a doctor on my own ,and the doctor took x-rays and set me up with appointments for 6 shots in my neck and lower back. but since it isn't the Dr. they chose they don't want to pay them. this seems like i've been waiting for 6 months and nothing is getting done what should i do? My lawyer does'nt seem to care that i got fired and i don't know what to expect and how long i have to wait to get treatment and answers to what i can expect to happen and when. what should i do?

Each state has its own statute of limitations for workers compensation cases. Some states deny further medical care if you do not receive medical treatment within a year. Therefore, I strongly suggest you speak to your attorney about this so that you do not loose your rights. There are also other limitations in which to pursue workers compensation claims, such as indemnity claims.

mmi, then your case is ripe to settle or go to a hearing.

Some compensation cases take a long time to resolve, but if you are at mmi your case is ripe to settle. Again, not all cases are the same. You need to sit down with your attorney and see what he or she intends to do and, if your are unsatisfied, you can also obtain a second opinion and or obtain another attorney. Please note that without more, I cannot tell you if your attorney is doing everything correctly or not.
