Legal Question in Workers Comp in Florida
Minor Injury / WC
I injured my back and collar bone while washing some windows at work. While in a sling, I fell 2-3 days later in the lobby of our building where they were mopping. Wouldn't these be onsidered workers compensation issues? My employer is tring to tell me that it is regular insurance. I have already lost 6 vacation days and $ co-pays for the Urgent care doctor that I have been to see.

Yes these appear to be workers' compensation injuries. I would advise your employer in writing that you are requesting that they report the injury to their workers' compensation carrier and file a Notice of Injury. Also be sure to disclose to your treating doctor's how these injuries occurred. This is usually done on the initial intake documents the doctor's have you complete. If they do not file a claim through their insurance carrier you should hire an attorney in your area to help you get the benefits you deserve.

If the window washing and the fall both happened at work, you are correct that these are WC issues not group ins issues. Advise your employer to send in a notice of injury to the WC carrier and to give you your copy. If the employer refuses, call the employee assistance office (EAO) for workers' compensation and let them know your problem.
