Legal Question in Workers Comp in Florida
My pay rights
I hurt my hand in my job and a do not have any medical benefits. They told me they were going to give me the benefits and they have not. I have been working there for approximately 18 months. Am I entitled to a Lump sum payment/compensation for my injury. Should I get an attorney. Workers compensation is paying my hand surgery for right now, and will be paying me for the time lost from work. My concern is if my hand is not back to the way it was before the injury, how and who pays me for the loss of the use of my hand. My job as a housekeeper requires full use of my hands/arms and I'm afraid I won't be able to do the work.

Re: My pay rights
Florida law no longer has any money benefit for loss of wage earning capacity. You will receive some minimal weekly checks after the doctor says you are at MMI and releases you to return to work if he gives you an impairment rating. If you can't work after that you have to be able to prove your are permanently and totally disabled from any kind of work, even part time work, to get more benefits. A Florida Bar Board Certified Workers' Compensation lawyer might be able to help you. Each case is different.
