Prescrition for Handicapped Accessible Van for Scooter Transport
I have recently (01/08/07 been given a prescription for a Handicapped Accessible Van for Scooter Transport. It is medically necessary My car can not carry my prescribed scooter. Is there a statute mentioning the extent of time a Worker's Comp. insurance company has to comply?

Once an authorized doctor has prescribed something, the carrier has a 'reasonable' time to comply. Reasonable depends upon what is prescribed. A prescription for pain medicine should be approved immediately, a van is more complicated. Yet, since it was January and now it's almost June, reasonable, in my opinion, is over. An attorney can file a petition (claim) for you and get a judge to order the van be provided. Contact a FLorida Bar Board Certified Workers' Compensation lawyer in your area. It has been quite a long time since the prescription was issued. The employer/carrier have an obligation to review the doctor's request and let you know what they are going to do. It sounds like fromt he delay that nothing is being done. A Petition for Benefits can be filed. You may want to contact an workers' compensation attorney to assist you in this matter.
