Legal Question in Workers Comp in Florida

return to work

I injured back on the job and was seen by a doc. Two days later I went to a follow up and he says that I need to go to physical therapy and return for another follow up in 7-10 days. But he releases me to work for an hour a day. I can only sit, stand and walk for no more than an hour. He said that my employer will have to find somthing for me to do after that hour or send me home with pay. This just doesn't sound right. Shouldn't I go to physical therapy and the follow up first? Is this just a way to have workers comp not pay me and to put it all on my employer? What other job duties could I do if I can't sit stand or walk? Come on....Any ifo would be appreciative.

Thanks

Re: return to work

A brief answer to your question is that if your employer cannot accomodate your restrictions, then workers compensation has to pay you while you are out. The bad news is that workers compensation is not required to start paying you until you miss 2 weeks, and then you will be paid the second week of benefits. After missing 3 weeks or more, you will get the other two weeks. Some employers will pay the employee for the first week if the only lost time will be that 7 days, but is not mandatory. You should seek the advice of a qualified workers compensation attorney by phone conference if you require more specific information. Good luck
