Legal Question in Workers Comp in Florida
I tore my rotator cuff during a fall at work - the MRI shows the tear - I WAS approved for surgery by my WC Nurse, but the human resources manager has intervened, he has been manipulating (Sept 13, 2011) my WC claim and calling the WC Clam adjuster asking questions about my ability to do my job. He is sending them pictures of me working (doing my job) - so in each turn of this inquiry, things are sent to the Dr for review - I was placed on light duty back on Jan 18 - the WC nurse approved the surgery that week and all of a sudden it was put on hold . The pictures (I am not sure what they have) were taken of me working, NOW their question is to my Dr is "Is Surgery still necessary" _ I have been in a sling at work since my light duty form was given to them, they say that the cannot accommodate my light duty, even though others just recently with the same light duty have been accommodated. I called the Regional HR Manager recently on the HRM (different reason) in my store and feel this is also retaliation from him. I am in so much pain and havent slept a decent night in 6 months - being they cannot accommodate my light duty, I have been trying my best to do my job, with my arm in a sling, but still experience a lot of pain while doing do - I am at my wits end - I was told by someone that IF I hire and attorney that I have to disassociate my self from my company - I have been there 4 yrs and love my job.
