Legal Question in Workers Comp in Florida

Unsatissfied with current representation

Dear Sir/s,

I have 3 claims for the same employeer. 1st, 01/04/2001 + 3/12/2002- Carrier is FCCI Mutual- same injury (back- L5/S1 bulge disc, T5/6 bulge and T7/8 through T11/12 herniated discs impressing the thecal Sac and at level T11/12 compressing the cord. We have been referred to UM the Petition is filed- Attrn. have not get us the appointment. Instead FCCI is pressing me to go to a Neur.Sur for a Discogram whom is prof. affltd w/ another N.Surg, whom I saw last year 10/08/02,I'm back to non-working status. Attrn not helping to get me medical attn/ at UM instead telling me on how good my carrier +adjtr are. 2 case was 7/2000- Carrier USIS- Plantar Fascitis- Dr. wting for back to be stable for 2 foot surgery. We are not happy with current legal represent. Attrn since 08/2002. Everybody tells us if we fire this Attr.nobody will take our case but we are desperate because my health is getting worse, I have developed Apnea (Thoracic Hernias), H/b prssr.(Reaction to cortizone-epidurals) 80# more, chest pains, stomach pains,constant back pain radiating to my groin, testicles,and leg down to toes. Is it true that I can't change Attrn for one that is willing to enforce the Statutes that are pro my rights?

I would always suggest that you try to work out any problems you may have with your attorney prior to obtaining new representation. Sit down, go over your concerns and give that attorney the opportunity to resolve the issues. However, if you should not be able to resolve your differences, and you feel that you need new representation you shoudl certainly explore those possibilities. Best of luck.
