Legal Question in Workers Comp in Florida

WC FL settlement

I am a Registered Nurse. I injured my foot at work in Dec. 2006. I have an attorney but, I still do not understand the settlement process. He said something in the area of $2500 is what ''they'' will probably pay. I'm confused, does the insurance company dictate the amount of a settlement? I am still having sharp pain in my foot, especially after working three, 12 hour shifts in a row. Needless to say, my feet are my career. How can they say $2500? (I have plantar fasciitis). I injured the plantar tendon on a patients bed brake.

I agree with Mr. Rubin. You need to discuss this with your attorney.

However, reading between the lines you are expressing shock and disbelief that an insurance company could value a potentially career ending work injury at $2,500. The sad fact is that the Florida legislature (heavily lobbied by the insurance companies) has clearly said "We Don't Care!". It seems that every year they "reform" the work comp laws to to reduce the amount and length of benefits, increase the procedural hurdles to obtain the benefits, and make it economically impossible for attorneys to represent injured workers in obtaining benefits unreasonably delayed or denied. You should be outraged and commicate this outrage to your elected representatives. That is the only way that the system can be changed.

Since you have an attorney it is best to ask your attorney the question you pose. Ask him/her the basis of a workers' comp. settlement.
