Legal Question in Workers Comp in Florida

work comp question

I was injured on the job last year after falling 22ft. from an extension ladder, after being out of work for three months the doctor released me to go back on modified duty, upon returning to work I realized there was no such thing as modified duty at that company, when I let the supervisor know they were going against the doctors orders they fired me. As soon as I was terminated I called the comp company to request going back to the doctor, after four months they finally got me back to a doctor and he immediately casted my foot again and put me on a no work status, of course they started paying my benefits again but refuse to pay the four months it took them to get me back to the doctor. Are they responsible for that four month period?

Re: work comp question

Not only is the compensation carrier responsible for the 4 months you lost, the employer can be sued for wrongful termination. See a Board Certified Workers' Compensation Lawyer as soon as possible. The FLorida Bar maintians a list of Board Certified lawyers at its website, www.flabar.org.
